WHY DO THEY DO THAT?

They do that because most judges, juries and arbitrators trust the police, believe that they are honest, impartial and unbiased. If the police investigated the accident, collected the evidence and reached a certain conclusion, it surely must be so!

Thus, if the trucking company, or insurance company, can "help" the police investigate the accident, point out "critical evidence" to them, cooperate by making "important statements" available to them, and share the "expertise" of their trucking experts with them, who could possibly object to that?

Aren't they really just being good corporate citizens? Don't worry that by doing so they may be "controlling", or influencing, the outcome of the investigation and helping to produce a result that may, literally, save the company millions of dollars!

While you are on the way to the hospital, or laying in the emergency room, or recovering in intensive care, the truck line, its insurance company and their lawyers are hard at work -- even if its 2:00 a.m. in the middle of the desert! Why? Because there is BIG MONEY at stake! Their money! And, they intend to hang on to as much of it as they can!

BEWARE OF WOLVES IN SHEEPS' CLOTHING

Over and over, I hear the same refrain from people seriously injured in accidents, "...but he was so nice. He said he was sorry. He said it was all their fault. He said not to worry, that his company would take care of everything".

They are always describing the insurance adjuster, or the investigator, and they are always trying to explain why they gave him a written, or recorded, statement that "guts" their case, or gave him a carte blanche general authorization to release information that gave the insurance company the right to obtain their lifetime medical history, or their wage, personnel and payroll records -- even their income tax returns -- that (surprise, surprise) are now being used to bolster the company's contention that --the person's symptoms and complaints are, not the result of this horrendous truck accident at all but, the result of some long time pre-existing, but previously non-symptomatic, condition, or that, on average, their income earning capacity over the years has been far less than what they are presently losing while laid-up in the hospital.

Insurance adjusters, investigators, defense lawyers are all "nice guys". And, the women who have moved into those fields in recent years are "wonderful", and so sympathetic! Of course, they are nice! They are trained to be nice. "Nice" is their stock and trade. It is the technique by which they get you to trust them, to let your guard down, to give them statements that they can later use against you.

It is the means by which they get you to sign authorizations, and releases, that are against your interest. It is how they get you to settle your case on their terms while making you feel lucky to be getting 10¢ on the dollar! They are real nice.

Incidently, do not be impressed by some investigator, or adjuster, reassuring you that his company "admits fault", "accepts full liability", and will "take care of everything". Invariably those who make those statements have absolutely no authority to do so and, if confronted with those statements, the company will simply disavow them. They are meaningless and are merely intended to lull you into a false sense of security, and to "control" you, and to keep you from obtaining the competent legal advise you so desperately need.
